Terms of Service

1. Service Description

PDF Toolkit ("the Service") provides online tools for manipulating PDF files, including merging, splitting, and compressing documents. The Service is operated by PDF Toolkit ("we", "us", "our"). By using the Service, you agree to these Terms of Service.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Upload files containing malware, viruses, or any malicious code
• Upload files containing illegal content, including but not limited to child exploitation material, content that violates intellectual property rights, or content that violates applicable laws
• Attempt to circumvent rate limits or access controls
• Use the Service to process files in a manner that violates third-party rights
• Use automated tools (bots, scrapers) to access the Service beyond the provided API, unless you are on the Pro tier
• Attempt to disrupt or overload the Service infrastructure

We reserve the right to suspend or terminate access for any user who violates these terms.

4. File Size and Rate Limits

Free users are limited to 10 operations per 24-hour period and a maximum file size of 100 MB. Pro subscribers have higher limits as described in the Service Tiers section. We reserve the right to adjust these limits to ensure fair usage and service stability.

5. File Handling and Privacy

Files uploaded to the Service are processed on our servers and deleted immediately after the result is delivered. We do not retain, inspect, or share the contents of your files. For full details on data handling, please see our Privacy Policy.

6. Payment and Subscriptions

Pro access is granted via a one-time payment and does not expire. Payments are processed through our payment providers (Stripe or Lemon Squeezy). Refunds are handled on a case-by-case basis; please contact us if you have billing concerns. Lemon Squeezy handles EU VAT compliance for European customers.

7. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:

• The output quality of processed PDFs will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• PDF formatting, fonts, images, or metadata will be perfectly preserved during processing

You are responsible for verifying the output files before using them for any critical purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 50, whichever is greater.

9. Intellectual Property

You retain all rights to the files you upload and the processed output. We claim no ownership or rights over your content. The Service itself, including its design, code, and branding, is our intellectual property.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria and applicable European Union regulations. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Sofia, Bulgaria.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. If changes are material, we will make reasonable efforts to notify active subscribers. Continued use of the Service after changes constitutes acceptance of the revised Terms.
